1. What Custoomy is

Custoomy is a platform for people who work with customised clothing and promotional products: a product catalogue, free tools for designing and estimating, editorial content and a configurator that shows how a print will turn out. Custoomy does not sell the products it shows and is not a party to the contracts you enter into with suppliers or printers.

The service is run by Cama Davide, with its registered office at Via E. Musolino 3, 89135 Reggio Calabria (RC), Italia, VAT number 03326110800. To write to us: hello@custoomy.com.

2. Account

Some features require an account. You undertake to provide true information, to keep your credentials to yourself and to be responsible for what happens from your account. The account is personal: it cannot be transferred or shared. You can delete it whenever you like from your profile, and the data linked to it goes with it.

3. Permitted use

By using Custoomy you undertake not to:

• extract catalogues, content or images in bulk, with or without automated tools;
• circumvent technical limits, authentication or protection mechanisms;
• upload material that is unlawful, offensive or that you do not hold the rights to;
• use the service for activities that compromise its operation or security;
• extract or collect, even a little at a time, the data the tools use in order to work: print areas, positions, calibrations, masks and rendering parameters of every product and colour;
• decompile, analyse or reconstruct the code, algorithms or parameters of the configurator, except where the law expressly permits it;
• circumvent the viewing limits, including by opening several accounts or having others do so;
• use previews, data or parameters obtained from Custoomy to build, train or feed similar or competing services.

To protect the service, the number of new products an account can open in the configurator is limited: currently 20 every 24 hours and 50 every 7 days. Products already opened always remain available. If your work requires more, write to us: we can raise the limit for your account.

If this happens, we may suspend the account. Where the conduct is serious or repeated, we may also close it.

4. The files you upload

The logos and images you upload remain yours. You warrant that you have the right to use them and you grant us a limited, non-exclusive and revocable licence to store and process them for the sole purpose of showing you the result and generating your documents. We do not use them for anything else, we do not show them to other users and they disappear when you delete them or when you delete your account.

When you download the preview or the technical draft from MyMockup, or use “Save”, the mockup is saved in your Configurations area together with the logos it uses and a small preview, in a private space. You can rename, duplicate or delete it whenever you like; a logo is deleted when none of your mockups uses it any more. PNG and PDF files are not kept: they are regenerated from the mockup every time you download them.

5. Previews are simulations

What the configurator shows is a simulation: it reconstructs how a design will sit on a garment, at what size and with what apparent rendering of the chosen technique. It is not a print proof and it is not a colour proof. The colours on screen depend on your monitor, and the actual result depends on the fabric, the machine and the printer's choices.

The measurements and quality checks you see — print area, resolution, legibility of details — are indications calculated on the file you uploaded, and are there to avoid obvious mistakes before going into production. They do not replace the printer's approval.

6. Catalogues, technical data and prices

Product pages, sizes, compositions, images and colours come from the catalogues of brands and distributors. We standardise them and keep them up to date with due care, but we cannot guarantee their accuracy or currency: before ordering, the reference is the supplier's catalogue. The same applies to prices and estimates: they are indications to help you decide, not offers.

7. Intellectual property

The site, the software, the graphics, the editorial texts and the results produced by the tools belong to Cama Davide or to whoever has granted us their use. You may use them for your work; you may not resell them, republish them in bulk or present them as your own.

The data the configurator uses to show previews is a database built by Cama Davide through a substantial investment of work and time: it includes, for every product and every colour, print areas, calibrations, masks and positions. It is protected as a database (Articles 102-bis et seq. of legge 633/1941, the Italian copyright law) and, where applicable, as confidential information. Using the tools does not transfer to you any right in this data.

Embedding the configurator or other Custoomy tools in third-party websites or applications, by embed, API or any other means, is permitted only under a written agreement with Cama Davide.

8. Availability and liability

The tools are offered free of charge and made available as they are. We do our best to keep them working and accurate, but we do not guarantee that the service will always be available or free of errors. To the extent permitted by law, we are not liable for indirect damage, loss of profit or the consequences of production decisions taken solely on the basis of a preview.

Nothing in these terms limits the rights that the law grants to consumers.

9. Changes

We may update these terms. When the change is substantial, we update their date and ask you to accept them again the next time you sign in. The version in force, with its date, is always at the top of this page.

10. Governing law

These terms are governed by Italian law. For disputes with users who are consumers, the court of the consumer's place of residence or domicile remains competent.
